In a landmark judgment that affirms the constitutional rights of religious practice and cultural preservation, the Brambha Baba Mandir has emerged victorious in a legal case brought against it by the District Council of Flacq. The decision has been hailed as a triumph for the local Hindu community, devotees of Brambha Baba, and defenders of traditional places of worship across the island.

The Council sought to impose a very harsh pull-down order, on the basis that the Brambha Baba Mandir encroached by 5 cm on a public road. However, the Brambha Baba Mandir trustees and legal team argued that the temple had long served as a community spiritual center, existing peacefully for years with the support and participation of local residents. They stressed that the Mandir was not a commercial entity but a sacred place of prayer, community service, and cultural continuity, especially for those who follow Sanatan Dharma.
Most importantly, the counsel for the Mandir were able to demonstrate that the officers of the District Council did not know the details of the case. They could not ascertain dimensions. Furthermore they seemed to barely be aware of critical information when cross-examined by counsels. Counsels for the Mandir were Maitre Ashley Hurhangee and Maitre Pravesh Nuckchady.
